Government Wins Tampa Case In Federal Court
September 17, 2001
The Federal Government has had a victory in the Federal Court in the case of the Tampa asylum-seekers. The full bench of the Court has overturned last week's decision by Justice Tony North and found that the government was "acting within its executive power under Section 61 of the Constitution.
The full bench comprised Justices Beaumont and French in the majority, with Chief Justice Black dissenting. Click here to read a summary of the judgement.
The victory is unlikely to be appealed to the High Court and means that the government's political case in support of its treatment of asylum-seekers has been strengthened.
